Who needs soft-on-crime judges when the district attorney doesn’t even want to lock up the bad guys?
Manhattan’s new DA has ordered his prosecutors to stop seeking prison sentences for hordes of criminals and to downgrade felony charges in cases including armed robberies and drug dealing, according to a set of progressive policies made public Tuesday.
In his first memo to staff on Monday, Alvin Bragg said his office “will not seek a carceral sentence” except with homicides and a handful of other cases, including domestic violence felonies, some sex crimes and public corruption.
“This rule may be excepted only in extraordinary circumstances based on a holistic analysis of the facts, criminal history, victim’s input (particularly in cases of violence or trauma), and any other information available,” the memo reads.
Assistant district attorneys must also now keep in mind the “impacts of incarceration,” including whether it really does increase public safety, potential future barriers to convicts involving housing and employment, the financial cost of prison and the racial disparities over who gets time, Bragg instructed.
In cases where prosecutors do seek to put a convict behind bars, the request can be for no more than 20 years for a determinate sentence, meaning one that can’t be reviewed or changed by a parole board.
“The Office shall not seek a sentence of life without parole,” the memo states.
Under state law, that punishment is reserved for the most heinous of murderers, including terrorists, serial killers, cop killers and fiends who kill children younger than 14 during in connection with sex crimes or torture.
Bragg’s memo also detailed the following instructions for prosecutors to reduce charges filed by cops in various cases:
Armed robbers who use guns or other deadly weapons to stick up stores and other businesses will be prosecuted only for petty larceny, a misdemeanor, provided no victims were seriously injured and there’s no “genuine risk of physical harm” to anyone. Armed robbery, a class B felony, would typically be punishable by a maximum of 25 years in prison, while petty larceny subjects offenders to up to 364 days in jail and a $1,000 fine. Convicted criminals caught with weapons other than guns will have those felony charges downgraded to misdemeanors unless they’re also charged with more serious offenses. Criminal possession of a weapon in the third degree, a class D felony, is punishable by up to 7 years behind bars. Burglars who steal from residential storage areas, parts of homes that aren’t “accessible to a living area” and businesses located in mixed-use buildings will be prosecuted for a low-level class D felony that only covers break-ins instead of for more serious crimes. Those more serious crimes, class B and class C felonies, would be punishable by up to 25 and up to 15 years in prison respectively. Drug dealers believed to be “acting as a low-level agent of a seller” will be prosecuted only for misdemeanor possession. Also, suspected dealers will only be prosecuted on felony charges if they’re also accused of more serious crimes or are actually caught in the act of selling drugs. That felony would mean facing up to seven years behind bars.

The so called community: Victim: An Illinois police sergeant was pleading for her life moments before she was fatally shot with her own service weapon by a gunman in a hotel last week, documents provided to Fox News show. "At the time Sullivan fired the fatal shots into Sgt. Rittmanic, Sgt. Rittmanic was pleading with them to just leave, 'you don't have to do this, please just go, please don't please don't.' She was desperately pleading for her life," Kankakee County State's Attorney Jim Rowe said in court Monday. Bradley Police Sgt. Marlene Rittmanic and Officer Tyler Bailey were shot Dec. 29 while responding to a Comfort Inn Hotel along a highway in Kankakee County regarding barking dogs that were left in a vehicle. They found the room where the vehicle’s possible owner was staying and were shot while talking to the people in that room, the sheriff's office said. I was just reading about this, this morning, pretty sad you go on a call about barking dogs and you end up dead. I'd be interested in knowing why they decided they had to shoot these officers. It really makes no sense.

I was just reading about this, this morning, pretty sad you go on a call about barking dogs and you end up dead. I'd be interested in knowing why they decided they had to shoot these officers. It really makes no sense. My guess is they were wanted for "community outreach issues". This demographic suffers from impulse control and kills more people (including cops) than any other race as a percentage of the population. A day after leaving the company in June 2017, Xiang attempted to return to China on a one-way ticket but was searched by federal officials. Investigators later found that one of Xiang’s devices contained copies of the Nutrient Optimizer.
Xiang was allowed to fly to China, where he worked for the Chinese Academy of Science’s Institute of Soil Science, which is run by the Chinese government, but was arrested upon returning to the U.S.
On Jan. 6, Xiang pleaded guilty to conspiracy to commit economic espionage. According to the Justice Department, he “faces a maximum prison sentence of 15 years, a potential fine of $5 million and a term of supervised release not exceeding three years.”
“Despite Xiang’s agreements to protect Monsanto’s intellectual property and repeated training on his obligations to do so, Xiang has now admitted that he stole a trade secret from Monsanto, transferred it to a memory card and attempted to take it to the People’s Republic of China for the benefit of Chinese government,” Assistant Attorney General Matthew G. Olsen of the Justice Department’s National Security Division said. “With his guilty plea, Xiang is now being held accountable for this unlawful conduct.”

Party of science:
Leading British and US scientists thought it was likely that Covid accidentally leaked from a laboratory but were concerned that further debate would harm science in China, emails show.
An email from Sir Jeremy Farrar, director of the Wellcome Trust, on February 2 2020 said that “a likely explanation” was that Covid had rapidly evolved from a Sars-like virus inside human tissue in a low-security lab.
The email, to Dr Anthony Fauci and Dr Francis Collins of the US National Institutes of Health, went on to say that such evolution may have “accidentally created a virus primed for rapid transmission between humans”.
But a leading scientist told Sir Jeremy that “further debate would do unnecessary harm to science in general and science in China in particular”. Dr Collins, the former director of the US National Institutes of Health, warned it could damage “international harmony”.
Viscount Ridley, co-author of Viral: the search for the origin of Covid, said: “These emails show a lamentable lack of openness and transparency among Western scientists who appear to have been more interested in shutting down a hypothesis they thought was very plausible, for political reasons.”
In the emails, Sir Jeremy said that other scientists also believed the virus could not have evolved naturally. One such scientist was Professor Mike Farzan, of Scripps Research, the expert who discovered how the original Sars virus binds to human cells.
Scientists were particularly concerned by a part of Covid-19 called the furin cleavage site, a section of the spike protein which helps it enter cells and makes it so infectious to humans.
Summarising Professor Farzan’s concerns in an email, Sir Jeremy said: “He is bothered by the furin site and has a hard time (to) explain that as an event outside the lab, though there are possible ways in nature but highly unlikely.
“I think this becomes a question of how do you put all this together, whether you believe in this series of coincidences, what you know of the lab in Wuhan, how much could be in nature - accidental release or natural event? I am 70:30 or 60:40.”
Later emails showed that by February 4, Sir Jeremy had revised his estimate of a laboratory leak to 50:50, while Professor Eddie Holmes, of the University of Sydney, gave a 60:40 estimate in favour of an accidental release.
The emails also show that Bob Garry, of the University of Texas, was unconvinced that Covid-19 emerged naturally.
“I just can’t figure out how this gets accomplished in nature,” he said.
Professor Andrew Rambaut, from the University of Edinburgh, also said that furin cleavage site “strikes me as unusual”.
He added: “I think the only people with sufficient information or access to samples to address it would be the teams working in Wuhan.”
The new details came to light after members of the US Republican House Oversight Committee were granted access to the documents, after complaining that their content had been heavily redacted when released under Freedom of Information requests.
The emails were sent in response to a teleconference between 12 scientists including Sir Patrick Vallance, the Government's chief scientific adviser, on February 1.
The emails show that by February 2 2020, scientists were already trying to shut down the debate into the laboratory leak theory.
An email from Dr Ron Fouchier to Sir Jeremy said: “Further debate about such accusations would unnecessarily distract top researchers from their active duties and do unnecessary harm to science in general and science in China in particular.”
Dr Collins, former director of the NIH, replied to Sir Jeremy stating: “I share your view that a swift convening of experts in a confidence-inspiring framework is needed or the voices of conspiracy will quickly dominate, doing great potential harm to science and international harmony.”
Institutions which held the emails have repeatedly resisted efforts to publish their content.
The University of Edinburgh recently turned down an Freedom of Information request from The Telegraph asking to see Prof Rambaut’s replies, claiming “disclosure would be likely to endanger the physical or mental health and safety of individuals”.
James Comer, the Republican congressman who secured the unredacted emails, said it showed that experts like Dr Fauci had taken the Wuhan lab leak theory “much more seriously” than they had let on.
Sir Jeremy has been approached for comment but had not replied at the time of publication.

"I was just charged with 18 different counts, that was dropped to 10, that was dropped to one. When I shouldn’t be out right now. I disrupted somebody’s life. I traumatized somebody because of how I felt in a situation," Luther Trent said, according to WBFF. "Personally, yes, I want to be out but principally, no I shouldn’t be out because I could have done a lot more damage than I did. I was expecting to get time. People who were in that situation, they should expect to get time."
Trent pleaded guilty to one count of first-degree arson after setting his ex-girlfriend’s house on fire while she and her two roommates were inside in May of last year. He was released from jail after serving fewer than six months due to a plea deal from the Baltimore City State’s Attorney’s Office.

About 100 people charged with murder in Cook County, Illinois, are on home monitoring, not behind bars, according to the sheriff.
"Seventy-five to 80 percent of my people on home monitoring are charged with a violent offense," Cook County Sheriff Tom Dart said Monday, CBS Chicago reported. "I have about 100 people on home monitoring who are charged with murder."
Chicago is located in the county and is home to more than 40% of Illinois residents. It is the second most-populous county in the country, behind Los Angeles County. Dart said the electronic monitoring program in his county is the largest in the country, with about 2,600 people in the program.

A female captain who may become the Air Force’s first woman to complete its elite special tactics training raised concerns about the program’s shifting standards as early as April 2021, Air Force Times has learned.
Multiple documents obtained by Air Force Times — including performance forms, score charts and a report the woman authored shortly after dropping out of a land navigation event — illustrate how she was allowed to return to training after she quit, and how physical training metrics were lowered just as she arrived at the challenging schoolhouse.
“I believe the change in standards invalidated me with a majority of my team,” she wrote in an April 2021 memo to an unnamed master sergeant about her experience at the school. “One [instructor] cadre member had a conversation with a student and said that the cadre ‘rioted’ when they found out the PT test was changing back to lesser standards.
“Perhaps all of this timing was coincidental, but looks highly suspicious with my arrival on campus,” she added. Air Force Times is withholding her name for privacy reasons.
The airman’s account and other paperwork contradict public statements that Lt. Gen. Jim Slife, the head of Air Force Special Operations Command, issued during the first week of January to refute claims that his organization is unfairly pushing an unqualified female airman through special tactics training.
An anonymous letter circulated online alleged that AFSOC tweaked the training benchmarks to her benefit and allowed the woman to return after she tried to quit the program three times.
In statements to the press and a Jan. 7 letter to airmen, Slife said the anonymous letter was inaccurate and took the situation out of context.
“We do make changes in how we train airmen in order to improve the effectiveness of our training, but we do not lower our standards. … Period,” he wrote.

I saw a report on TV that the Santa Clara County sanitation district was putting in monitoring stations in thee sewers to test bacteria in the system and they can pinpoint covid in certain areas of the county. It was really interesting how the system actually worked
